I'd hate to see the current administration have any more tools available to misuse, but it does seem to me that we may have thrown out the baby with the bathwater here.

The Republican position on the independent counsel seems to be "clearly it isn't a good idea - look how we've misused it"

See, here's the thing: I think the "independent counsel act" (or more properly "ethics in government act") was unconstitutional as written. I can't help but wish that the Dems let it expire two years later, however. Clinton would have survived it, and we'd have some actual answers (or at least more press on the fact that we don't) now.
